An Ohio Newspaper Association training organized by the ONA Circulation Managers Committee
Independent contractor relationships are in flux these days, with both lawsuits and aggressive enforcement by government agencies creating challenges for all newspapers. To help ONA members sort out the dos and don’ts of independent contractors, the ONA Circulation Managers Committee has organized this one-day training from experts Michael Zinser and Richard Hively, who have conducted dozens of seminars across the country explaining ways to ensure that independent contractors remain independent and how to minimize nuisance litigation.

About the Trainers
L. Michael Zinser is the founder of The Zinser Law Firm in Nashville, Tennessee. The Zinser Law Firm has a heavy concentration of clients in communications media, representing over 250 newspapers. He is an honors graduate of the University of Cincinnati and received his law degree from Vanderbilt University School of Law in 1975. He is a member of the Antitrust, Labor Law, and Litigation Sections of the American Bar Assn. Zinser is listed in the Bar Register of Preeminent Lawyers for Labor and Employment Law, the national legal directory that rates lawyers. He is a member of the ABA’s standing committee on Practice and Procedure under the National Labor Relations Act. He is also a member of the Employee Relations Committee of the Newspaper Association of America. Since 1975, Michael has spent the great majority of his time representing communications companies and industry trade associations. His 38 years of practice has, in particular, focused on labor/employee relations and circulation legal issues. He is a 2014 inductee to the National Circulation Directors Hall of Fame and the first non-circulation director ever to be inducted.
Rick Hively is the President of Wilson Gregory Agency. He was raised in Kansas and attended the University of Kansas. He began his newspaper career in Lakeland, FL as a District Circulation Manager and was then promoted to Circulation Sales Manager. He left there to become the Circulation Sales Manager in Lawrence, KS and was recruited to join Hickey-Mitchell Insurance Company in 1977. Hively spent 10 years with Hickey-Mitchell Company, becoming West Coast Manager in 1985. In 1987 he became an independent contractor for Wilson Gregory Agency. He assumed the role of National Sales Manager in 1991 and became President of the company in 1998. Wilson Gregory Agency is the largest producer of independent contractor accident insurance programs and independent contractor bond programs in the United States. The company has agreements with nearly 750 daily newspapers and over 100 Distribution Companies nationwide.
